WOW rude dumb ass

Mine:
I noticed a lot of drama occurring around one of your pictures and I myself made a comment or two.
To be honest, most art sites would consider what you have done complete and utter art theft. DA has a few weird twisty rules.
There's one good fix so everyone gets off your back and you remain happy.
Use the desktop YOU have edited, screencap your desktop screen(WITH icons). Upload it here to dA as a DESKTOP. This is allowable and where a lot of the confusion comes from regarding what we can and can't upload.
Then, provide a link in the description to a version on photobucket(or another picture uploaded of your choice) where people can download it for themselves.
People will instantly stop bothering you by the mere fact you have desktop icons over part of it. Seriously.
I know it's obnoxious, but no other site would let you get away with this and thats one reason people get mad at dA ALL the time. They allow art theft like this. If I took a picture of the Mona Lisa and made her frown. It would be a minor edit, but would it be correct of me to do it?

I understand HOW much work went into this. I've done picture edits so I could use them on my LJ and other sites for BGs. It can be a TON of work. Sometimes more than just coloring your own piece because you have to find the perfect shades and blend them. If it's a scan it can have a lot of stuff wrong with it. Just please understand how other fans of the series feel. We see this as you stealing from the artist. Just because you don't make money from it doesn't mean it's not stealing. If I steal money from a bank, I stole it even if I never spend any of it.

HERS:
So, I take it YOUR the one who screwed off my pictures? WELL WHY THE HOLY H*LL DID YOU TAKE THEM OFF, AND THEN TELL ME THIS?!?? I don't even know what the holy shiz your spouting. I"M. A. KID; TEENAGER. I DON"T KNOW WHAT YOU MEAN BY

"Use the desktop YOU have edited, screencap your desktop screen(WITH icons). Upload it here to dA as a DESKTOP. This is allowable and where a lot of the confusion comes from regarding what we can and can't upload.

I. DONT. THINK. I. CAN. GET. A. PHOTOTBUCKET.MY. MOM. PROBABLY. WONT. LET. ME. And, for those Photoshop pictures *I* MADE, THATS ALLOWED. IF I PHOTO SHOPPED SOMETHING LIKE THAT, FOR *PARODY* OR, EVEN IF I ADD TO MY OWN WORK, THATS ALLOWED. I SAID THAT I HAD CONTACTED PEOPLE IN CHARGE, AND YOU WERE *WAY* OUT OF LINE TO REPORT THESE. I MADE THEM. I NEVER CLAIMED SAIYUKI AS MY OWN. WHAT I DID, IS CALLED "SPLICING." I WAS TOLD BY SOMEONE ELSE THAT WAS ALLOWED.

ANd, YES. I THInk its FINE for you to take the Mona Lisa, and make her frown. AS LONG AS YOU DON"T CLAIM IT AS YOUR OWN ORIGINAL PAINTING.

I am LITERALLY *OBSESSED* WIth Saiyuki. Goku, even MORE For that matter. It PISSES ME OFF when people make Sh*t Yaoi or other crap stories, of things that could NEVER Happen. I LOATH people who do that. I am one who knows EVERY SINGLE LINE OF THE 50 EPISODES OF SAIYUKI, NOW WORKING ON THE 2 AND 3 SEASONS. ITS THE ONLY THING I WRITE ABOUT IN STORIES, WHAT I QUOTE, WHAT I THINK ABOUT PRACTICALLY 24/7. I EVEN SLEEP WITH A PILLOW. THIS IS THE ONLY ANIME, THAT I EVER BEEN SO INTO. I PROBABLY HAVE ALMOST EVERY OFFICIAL GOKU PICTURE SAVED ON MY PC. EVERY DREAM I HAVE, INCLUDES SOME FORM OF SAIYUKI IN IT. NO. JOKE ABOUT THAT.

I *DONT. CANT* UNDERSTAND HOW OTHERS FEEL ABOUT IT, BECAUSE I AM THE BIGGEST FRIGGEN SAIYUKI FAN, YOU HAVE EVER, AND WILL, EVER ENCOUNTER IN YOUR LIFE. AND IT DOESN"T BUG ME. BUT; IT PISSES ME OFF, WHEN YOU IGNORE THE FACT THAT I"VE CONTACTED PEOPLE IN CHARGE, AND YOU *STILL* WONT BUTT OUT!!!

ANd your compairison, doesn't even FIT this. STEALING, IS YOU TAKE IT, AND CLAIM IT YOUR OWN. YOU DON"T GIVE IT BACK. I SAID, I. DIDN"T. CLAIM. SAIYUKI. AS. MY OWN. WHY, ARE YOU PICKING ON ME?!?? DO YOU HAVE ANY IDEA HOW MANY PEOPLE I HAVE RAN INTO WHO JUST PUT "I love So-and-So." NO MORE. THEN NEVER SAID IT WASN"T THEIRS!!! THEY NEVER EVEN CREDITED ANYONE ELSE FOR THE WORK!!!! WHY GET ANGRY AT THE PEOPLE, WHO ACTUALLY CREDIT THE OWNER?!?

EVER HEARD OF THE COLOR CODE? MY BIGGEST COLORS ARE YELLOW, AND THEN RED. I. DONT. GO DOWN WITHOUT A FIGHT. I HAVE A REAL TEMPER THAT I ALSO GET FROM MY PARENTS. REDS ARE THE POWER WIELDERS, THEY HATE LOSING, HAVE A BAD TEMPER, ARE SERIOUS, FIGHT THE POWER, LIKE TO BE INCHARGE, *DISPISE* PEOPLE WHO TRY TO CHALLENGE THEM, AND GET REVENGE QUICKLY, AND DON"T FORGIVE QUICKLY. YELLOWS, THE FUN LOVERS, EXPRESS WITH FACTS, LOGIC, AND FEELINGS. THEY FIGHT THE POWER AS WELL, AND *DON'T* LIKE BEING TOLD WHAT TO DO. ALSO, FOR YELLOWS, YOU SHOULD *NOT* IGNORE THEM. ESPECIALLY IF THEIR A RED/YELLOW COMANATION. THAT WILL ONLY PISS THEM OFF, AND THEY WILL BECOME MORE OBNOXIOUS. I WONT BECOME OBNOXIOUS, BUT YOUR PISSING ME OFF PRETTY BAD.

YOU HAD NO RIGHT TO TAKE MY ART OFF, WHEN I CALLED IN A REFFERIE. SPLICING IS ALLOWED HERE, SO DON"T YOU *DARE.* TAKE MY MY PHOTO SHOP WORK OFF.

MINE:
Actually, dA took them down because of copyright infringement. Go ahead and reupload them, but I don't have the power to take them off. I can of course re-report you for uploading them again.
and this note, if you look at the date was sent a couple days before I did that.
OH, and hun, I've been with Saiyuki since Minekura first created it. I've been obsessed with the BASE story of Saiyuki, the one Minekura is COPYING. I have a Sanzo tattoo and believe me when I understand obsession. Noticed the name on here? I know every line from all the manga, anime, special drama c.d.s, the video games, and the move. I own every artbook by Minekura. And just so you know, Minekura is a yaoi writer. The first book she ever wrote for Saiyuki back in High School was yaoi. She just rewrote for commercial sale. She MAKES constant jokes about them being gay. She doesn't say they are but she makes jokes about it.

You think you're a fan, but you're not. What you're doing is wrong. And I can even show you the e-mail I received back from dA when they deleted your stuff. Upload it and I'll just report it again. And yes, photo splicing is allowed, with your own photos. Stop being a tard.

HER:
Oh,SanzosKitten, btw,

...My Homura picture...Is a PARODY. its labled under Commentary.
This is from one of their sites that they put under FAIR USE. The Copyright & Etiquette Administration Manager sent me this as well as the site previously sent to you.

LOOK UNDER FAIR USE. CLICK ON THE SECOND LINK, AND THEN CLICK COMMENTARY AND CRITICISM. THIS IS WHAT IS SAID:

2. Parody

A parody is a work that ridicules another, usually well-known work, by imitating it in a comic way. Judges understand that by its nature, parody demands some taking from the original work being parodied. Unlike other forms of fair use, a fairly extensive use of the original work is permitted in a parody in order to "conjure up" the original.

MINE:

I don't know where you got the idea that I have the ability to delete any of your pictures. I merely reported them to the copyright infringement policy people of dA and THEY deleted them. I can show you their e-mail.
ANY and ALL use of registered material WITHOUT permission is fringing upon copyright. You can parody something without using it as well. While in parody works you are allowed a certain amount of use of it that doesn't mean you get to take all of it. The dA staff took your works down, not me. And the second time it was reported wasn't even me. It was one of the other people who commented on the piece.

HER:
i DIDN"T use all of it. Does Homura have his own body? Does the original girl have a head? No. I didn't use ALL of the works in MOST of my pictures. that counts as a parody, so I don't NEED permission. I just COPIED the work; not INFRINGED it. THERES A DIFFERENCE. I emailed the Copy Rights Manager and told him whats going on. Their rules are contradicting. In the Copy rights, it says I cant edit the picture withought permission yes, but when the MANAGER posted, said what I was doing was just Copying and NOT infringing, I'm also doing FAIR USE. What I did is Parody, so its allowed. They cancel out; and they ALSO put in their Copy Rights forum, that Practically EVERY thing that is made, is in some form copyrighting unless it was YOUR ORIGINAL CHARACTER, AND DESIGN. I am allowed to use the IDEA. I CAN do that.

Alright. Send me the Email. I already said so before; do it. Show, me the Email. And you still haven't answered my question; what about people who do backrounds? Wallpapers? How much you wanna bet they don't have permission to take Kazuya's work? What about Icons? you'r using someone elses pictures, or you just took anothers Character and made it into something else; a differen't pose, a differen't face. As long as its recognizable, THAT can be counted as Copyrighting. Even when others KNOW you didn't make the character. SOOO...there for, they should have never even made this site.

MINE:
I am indeed making a list of ALL the desktops and Backgrounds on here to report them. So no, you are not the only one affected by this.

"y2jenn, Jul 12 09:08 am (PDT):
Appropriate action has already been taken. As you can see the images have been reviewed and those deemed necessary for action have received it. Thank you."

That was the e-mail I received after sending yours and several other people's submissions.
and to REPEAT:
What is Copyright Infringement?

To simplify this question, copyright infringement occurs when you do certain things with a creative work which someone else produced without first getting the proper permission.

Some examples of copyright infringement (this is only a partial listing) can include:
-Placing a photograph or creative work online without proper permission.
-Modifying or editing a creative work without proper permission.

ALSO:
What Happens When You Submit Infringing Works to deviantART?

When we become aware that a deviantART submission infringes upon the copyrights of another artist, creative person or company, we will immediately delete it. This is a legal requirement which we fulfill immediately; you will not receive an advanced warning and you will not be given an opportunity to 'fix it'. Any copyright owner following the procedures in this Copyright Policy can require deviantART to remove his or her copyrighted content.

If you believe that a submission on deviantART infringes upon your copyright you may either report the submission using our internal reporting system or send us a copyright notice via email. A member of staff will review your notice and resolve the situation.

If you believe that one of your submissions was removed in error you may contact our helpdesk or otherwise file a counter notice. A member of staff will be made available to you so that the situation can be properly resolved.

If you are found to repeatedly post infringing content your account will be suspended and serious offenders will have their account banned and deactivated. If you are found deliberately misrepresenting the copyrighted work of another as your own your account will be immediately banned and deactivated.

If this continues to happen I will be e-mailing the Geneon and Zero-sum corporations as they happen to have partial ownership of Saiyuki and they will not be happy to see their works used. I would e-mail Minekura on her private blog, but she is currently sick and needs rest in the hospital for her disease. I would not want her to feel so used as seeing what this place does to her works.

ALSO: while the work can be considered parody, it can still be considered copyright infringement. There have been MANY court cases that go back and forth on the subject and the MOD I reported it to deemed it copyright infringement.

That was 6 days and 14hours ago upon reviewing this note. Know what that means? Yup thats right, she NO LONGER HAD ANYTHING TO SAY. *smiles*
